Lightbox underlay issue

It there a way to make the lightbox override a themes static menu bar. My images are getting chopped off by the menu bar. I do want to keep it static on some pages, just not when the lightbox is in view. would this be css fixable in the theme?

The effect is worse in firefox (vs chrome) as the image appears above the menu bar as well.
